ON THE ISSUE OF THE CONCEPT AND GOAL OF INTERNATIONAL COOPERATION IN COUNTERACTING
CORRUPTION USING PROSECUTOR’S POWERS IN THE FIELD OF CRIMINAL PROCEEDINGS

Abstract

Background. Counteraction against corruption using prosecutor’s powers in the field of criminal proceedings is one of the constituent parts of international cooperation in the struggle against corruption. A question arises. What should be understood under international cooperation in counteracting corruption using prosecutor’s powers in the field of criminal proceedings? At the present time there is no answer to the question.
Materials and methods. The article analyzes scientific literature on the subject matter.
Results. International cooperation in counteracting corruption using prosecutor’s powers in the field of criminal proceedings has no such purpose as satisfying idle curiosity, but follows a concrete goal – counteraction against corruption. In generl, the goal of international cooperation in the given field is determined by article 4 of the Law on counteracting corruption from 25.12.2008 № 273-FZ. It is called “International cooperation of the Russian Federation in the field of counteraction against corruption”. The document states that “In accordance with international agreements of the Russian Federation and/or on the basis of reciprocity the Russian Federation cooperates in the field of counteraction against corruption with foreign contries, their law-enforcement bodies and special services, as well as with international organizations for the following purposes: 1) to identify persons suspected (accused) of corruption, to locate their whereabouts, as well as whereabouts of other persons involved in corruption crimes; 2) to reveal assets obtained by means of corrupt activities or being the means of corruption committment; 3) in proper cases to give items and substance samples for investigation and forensic examination; 4) to exchange information on the issues of counteraction against corruption; 5) to coordinate activities in corruption prevention and struggle”. Conclusions. The aim of international cooperation of the Russian Federation in the field of counteraction against corruption and the aim of international cooperation in counteracting corruption using prosecutor’s powers in the field of criminal proceedings correlate as the whole to a part. Such correlation allows us to state that the properties of the whole are immanent. From this perspective we can make the following conclusion. The aim of international cooperation in counteracting corruption using prosecutor’s powers in the field of criminal proceedings is: 1) to identify persons suspected (accused) of corruption, to locate their whereabouts, as well as whereabouts of other persons involved in corruption crimes; 2) to reveal assets obtained by means of corrupt activities or being the means of corruption committment; 3) in proper cases to give items and substance samples for investigation and forensic examination; 4) to exchange information on the issues of counteraction against corruption; 5) to coordinate activities in corruption prevention and struggle.
